FOSAF’s legal team have now filed their Heads of Argument at the North Gauteng High Court in the matter between FOSAF and the Minister of Environmental Affairs.
This matter relates to the Department of Environmental Affairs (now DEFF) failure to comply with the legal requirements for listing species as invasive in their Notices amending the NEMBA AIS Lists and Regulations. We now await the Department of Environment, Forestry and Fisheries to file their Heads of Argument and after this is done the matter can be set done for a hearing. FOSAF’s case will be based primarily on the department’s failure to provide sufficient information to allow for meaningful comment or objections, thereby thwarting the consultation process.
